BMW M240i Track Car Rental – Terms & Conditions

Vehicle Description

The rental vehicle is a professionally prepared BMW M240i track car. The vehicle is maintained to a high standard and undergoes routine inspections and maintenance prior to track use. The vehicle will be delivered to the event in track-ready condition.

Driver Eligibility

The renter must hold a valid driver's license, meet the experience requirements established by Edgar Lau Racing, be approved by Edgar Lau Racing prior to operating the vehicle, be the sole driver unless additional drivers have been approved in writing, and be accompanied by an Edgar Lau Racing-approved coach or instructor whenever the vehicle is being operated on track. The designated coach has the authority to provide driving instruction and make safety-related recommendations throughout the event. Edgar Lau Racing reserves the right to deny rental service to any driver at its discretion.

Coaching Requirement

The BMW M240i track car rental is offered exclusively as a coached rental program. A qualified coach must be present and assigned for the duration of the rental. Coaching fees may be included in the rental package or billed separately depending on the selected program. The renter agrees to follow all coaching and safety directives. Edgar Lau Racing reserves the right to suspend vehicle operation if the renter fails to comply with coaching or safety instructions.

Vehicle Fair Market Value

The agreed fair market value of the BMW M240i rental vehicle is $35,000 USD. If the vehicle is determined to be a total loss, deemed irreparable, or repair costs exceed its fair market value, the renter shall be responsible for up to the fair market value of the vehicle.

Damage Responsibility

The renter accepts full financial responsibility for any damage occurring while the vehicle is in their possession or under their control, including on-track incidents, off-track excursions, contact with vehicles, barriers, structures, or other property, and paddock or pit lane incidents. The renter is responsible for repair or replacement costs resulting from damage caused during the rental period.

Off-Track Excursion Inspection Fee

Any incident in which all four wheels leave the paved racing surface will result in a mandatory inspection fee of $500, regardless of whether visible damage is present. This fee covers vehicle inspection, alignment verification, suspension inspection, wheel and tire inspection, and associated labor required to determine vehicle safety and trackworthiness. Any repairs, replacement parts, alignments, towing, transportation, or additional labor required as a result of the excursion shall be billed separately and remain the responsibility of the renter.

Vehicle Operation

The renter agrees to operate the vehicle in a safe and responsible manner, follow all event, track, sanctioning body, and instructor rules, monitor vehicle gauges and warning indicators while driving, and immediately report any mechanical concerns, warning lights, unusual noises, or damage. The renter shall not modify, alter, adjust, or repair the vehicle without prior approval.

Mechanical Damage and Abuse

The renter shall be responsible for damage resulting from negligent or abusive operation of the vehicle, including continuing to operate the vehicle after a warning light, abnormal noise, vibration, or mechanical issue becomes apparent, contact with curbing, barriers, vehicles, or other objects, off-track excursions resulting in mechanical damage, failure to follow instructions from Edgar Lau Racing personnel or assigned coaches, or operating the vehicle in a reckless or intentionally abusive manner. Normal wear and tear associated with track use shall remain the responsibility of Edgar Lau Racing.

Consumables

The rental fee includes reasonable wear of consumable items associated with normal track operation, including but not limited to fuel, tires, brake pads, brake rotors, engine fluids, drivetrain fluids, and other routine wear items. Excessive wear, damage, or accelerated consumption of consumable components resulting from abnormal vehicle operation may be billed separately at the discretion of Edgar Lau Racing. Examples include repeated tire lockups resulting in flat-spotted tires, excessive wheelspin or burnouts, sustained operation beyond the reasonable grip limits of the vehicle resulting in excessive tire, brake, or drivetrain wear, repeated off-track excursions, contact with curbing, barriers, vehicles, or other objects, or driving conduct that causes wear or damage beyond what would normally be expected during a track day event. If Edgar Lau Racing determines that a consumable component has experienced abnormal wear due to driver operation that significantly shortens its useful service life beyond what would reasonably be expected during normal track use, or renders the component unsuitable for continued track use, the renter may be responsible for the cost of repair or replacement of the affected component(s).

Event Fees and Personal Expenses

The rental fee does not include track day entry fees, competition licenses, memberships, lodging, transportation, meals, personal equipment, insurance, or other personal expenses. These costs remain the sole responsibility of the renter.

Vehicle Recall

Edgar Lau Racing reserves the right to remove the vehicle from service at any time if unsafe driving is observed, vehicle abuse is suspected, continued operation may result in damage to the vehicle, or the renter fails to comply with event or safety regulations. No refund is guaranteed if vehicle use is terminated due to driver conduct.

Cancellations

Rental reservations require payment according to the booking terms specified at checkout. Deposits and payments may be non-refundable unless otherwise stated. Edgar Lau Racing may, at its sole discretion, offer a credit toward a future event.

Assumption of Risk

Motorsport and high-performance driving activities involve inherent risks, including serious injury, death, and property damage. By renting and operating the vehicle, the renter voluntarily assumes all risks associated with participation in track activities.

Photo and Video Release

The renter grants Edgar Lau Racing and its representatives permission to photograph, record, and capture video and audio during events involving the rental vehicle. The renter grants Edgar Lau Racing a perpetual, royalty-free right to use such photographs, videos, recordings, and related media for promotional, educational, marketing, social media, website, and business purposes without additional compensation.

Release and Indemnification

The renter agrees to release, defend, indemnify, and hold harmless Edgar Lau Racing, its owners, employees, contractors, instructors, and affiliates from any claims, losses, liabilities, damages, expenses, or legal actions arising from the renter's participation in any event or use of the vehicle.

Governing Law and Venue

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of California. Any dispute arising from or relating to the rental of the vehicle, participation in track activities, or these Terms & Conditions shall be brought exclusively in the state or federal courts located in Santa Clara County, California. The renter consents to the personal jurisdiction and venue of such courts.

Final Authority

Edgar Lau Racing reserves the right to refuse service, deny vehicle use, terminate a rental, or modify these terms at any time to protect the safety of participants and the condition of the vehicle.

By completing a reservation, the renter acknowledges that they have read, understood, and agree to these Terms & Conditions.
